Business Litigation Law Overview

Business litigation involves a wide variety of subject matters, including breach of contract, unfair competition, unfair business practices, copyright infringement, trademark and trade dress infringement, breach of warranty, breach of promissory note, breach of guaranty, breach of real estate agreements, partnership disputes, limited liability company disputes, breach of shareholder agreements, failure to pay invoices, fraud, and concealment.  In fact, commercial litigation can involve virtually any dispute between one business and another, or between owners of a business.  Klein & Wilson has experience in litigating a wide variety of commercial litigation matters.

Achieving Successful Results For Businesses

For over 20 years, Klein & Wilson's focus has been business litigation.  Klein & Wilson's courtroom experience in business litigation has caused some of the leading corporations in the world, including Boras Corporation, Delta Faucet, Behr Paint, Care Fusion, STM Networks Inc., Cequent Towing Products, Majestic Realty, Commerce Construction, Thermador, Inc., First American Title, Unisys Corporation, California Pacific Homes, Dacor Inc., Reese Products, Inc., Home Depot, Inc., and others to retain Klein & Wilson to represent them in their cases.  See Klein & Wilson's representative client list.

Klein & Wilson has a remarkable track record in business litigation.  In one case, Klein & Wilson's attorneys represented a limited partner suing a major media company that had "cooked the books" to deprive the client of any partnership profits.  The case went to trial and Klein & Wilson recovered over $26 million based upon a finding of fraud.  This recovery included $16 million in punitive damages, even though punitive damages are rarely recovered in business cases.

In a case involving claims of breach of contract and fraud, Klein & Wilson's aggressive litigation tactics caused a defendant to settle a case at trial.  The value of the settlement was approximately $12 million.

In another case, Klein & Wilson recovered almost $6 million against Siemens Business Communications, Inc. in a breach of contract action involving a marketing venture.  Klein & Wilson prevailed at trial and on appeal and also brought a successful malicious prosecution claim against the defendant for pursuing a frivolous cross-complaint against Klein & Wilson's client.  See significant case results for a list of other significant cases.
