The attorney sued our clients seeking more than $2.1 million representing alleged unpaid costs and fees, the bulk of which were “service charges,” arising from an oppressive interest clause in the fee agreement. Klein & Wilson eliminated many of the attorney’s claims on summary adjudication. After a three-day bench trial, the court found in favor of our clients on all remaining claims. The court agreed with Klein & Wilson that the fee agreement was void because the attorney did not comply with the State Bar Act; the attorney’s claims were barred by the statute of limitations; and the attorney could not prove our clients owed the attorney money.
