Defend yourself against copyright infringement

On Behalf of | Mar 1, 2017 | Intellectual Property

Copyrights are potent legal tools that can benefits individuals and companies. A copyright is a legal right that protects an original work of authorship that is fixed in a tangible form. This “fixed” form means that the work must be written down or recorded in some reasonable or permanent way. Without the “fixed” form of the authorship, it can’t be copyrighted.

When something is copyrighted, the person or company that holds the copyright is granted a number of exclusive rights:

  • You have the right to reproduce the work
  • You have the right to change and create new work based on the copyrighted material, which is called “derivative work”
  • You can distribute the work as you please
  • You can publicly display or perform the work
  • And, of course, you have the right to defend yourself from infringement

That last point is arguably the most important right granted under a copyright. Other companies and individuals can’t use your copyrighted work. The copyright is effectively a legal monopoly in that regard. So when other companies infringe on your copyright, it is imperative that you stand up to them and enforce your rights as a copyright holder. Otherwise, it effectively means nothing.
