What Is Negligent Representation?

The most common claim that clients assert against their lawyers is negligence – another word for legal malpractice. A lawyer is negligent when their representation falls below the standard of care of the profession.  To win a negligence case, clients must prove that a competent attorney would have achieved a better result for the client. The client typically proves negligence through expert witness testimony. Klein & Wilson regularly represents clients suing their former lawyers for legal malpractice in high stakes cases and has recovered millions of dollars for clients in these claims. See our significant case results page for a sample of our successes.

In 2009, the 600-member Orange County Trial Lawyers Association elected Gerald A. Klein as Trial Lawyer of the Year for trying professional negligence cases.
