Insurance Coverage

Insurance disputes involve either first or third-party coverage.  First-party policies, such as property policies, insure losses sustained by the policyholder.   Third-party policies are liability policies which protect policyholders against the costs of defending a lawsuit and paying for the judgment or settlement.   There are primary liability policies which provide a first layer of protection to policyholders, excess policies which generally apply after the limits of a primary liability policy are exhausted, and umbrella policies which can provide excess coverage and/or coverage when the primary policy fails to do so.  There also are "claims-made" and "occurrence" liability policies.  Claims-made policies, such as professional liability policies, generally cover claims made against the policyholder reported to the insurer during the policy period.  Occurrence-based policies, such as homeowners' liability policies and commercial general liability policies, provide coverage when the damage occurs during the policy period, regardless of when the claim is made.
